TORNESELLO DENIES CHARGE OF ASSAULT
Theodore Tornesello, 38, of 175 George St, Green Island, operator of Tornesello's Restaurant, Union St, Troy, pleaded innocent in two counts of assault 3rd degree in his arraignment in Troy Police Court today. Tornesello was arrested on the complaints of Doris and HarryArbour, husband and wife,who reside at 1813 7th Ave. The couple charged that Tornesello allegedly assaulted each of them in his place of business Monday at about 9:05 am. The wife alleges that she was struck about the back andbody and pushed into a chair by Tornesello, and the husband claims he was knocked to the floor and kicked in the head, face, and body by Tornesello. Tornesello was represented by John Mirch. James Straing appearedfor the complainants. Justice Joseph F. Daly granted Tornesello an adjournment until 17 May and released him in his attorney's custody.

ASSAULT CHARGES DISMISSED AGAINST RESTAURATEUR
Assault third degree charges against Theodore Tornesello, operator of Tornesello's Restaurant, Union Street, were dismissed in Troy Police Court today by Justice Joseph F. Daly when the complainants in the case failed to appear. Tornesello pleaded innocent in the charges which were lodged against him in Troy Police Court last 30 April bya Troy couple who alleges that they were assaulted by Tornesello in his restaurant. Doris and Harvey Arbour failed to appear in court this morning and the justice dismissed the action. There have been numerous adjournments in thecasesince the initial arraignment last April.

MAN FALLS IN STREET; TAKEN TO HOSPITAL
Harvey Arbour, 50, of1813 7th Ave, was taken to St Mary's Hospital early last night and treated for possible back injuries which, he claimed, he received when he slipped and fell on the south side of Broadway, near 7th Avenue. He was taken to the hospital by the Ambulance Service Corp, from Central Police Station, where he had gone for assistance. Patrolmen Richard Butler and David McClure of the radio patrol made the investigation.

HARVEY ARBOUR, 51, PAINTER, SUCCUMBS
Harvey T. Arbour, 51, a painter by trade, died last night at the Nightingale Nursing Home after a brief illness. A native of New Bedford, MA, he resided in Troy for 10 years. Surviving are his wife, the former Doris Kohler, and four daughters, Mrs.Richard Blinn and Miss Donna Jean Arbour, of Wethersfield, CT, Mrs. Charles Robinson of Elmwood, CT, and Mrs. Angelo J. DiMauro of CT. The funeral will be Saturday at 8:30 am from the William A. Toohey FuneralHome, 114th St and 2nd Ave, followed bya Requiem Mass at 9 am at St Peter's Church. Interment will be in St Peter's Cemetery.

The funeral of Hervey T. Arbour was Saturday from the WIlliam A. TooheyFuneral Home, 114th St and 2nd Ave, and from St Peter'sChurch, where arequiem High Mass was celebrated by Rev. Harry J. Flynn.Mrs. GenevieveB. Murphy was organist and sang the responses to the Mass. She sang "Miserere" at the processional, "Domine Jesu Christe" at the offertory, and "In Paradisum"atthe recessional. Bearers were Edward Pose, Ernest VanWert, Frederick O'Melia, and Charles Robinson. Father Flynn officiatedatthe grave inStPeter's Cemetery.he had 5 children but only 3 names could be found for now.
